  • Soccer whistle-blower hits out at FIFA's "culture of self-protection"
  • Phaedra Al-Majid unhappy FIFA rejected her breach of confidentiality complaint
  • "Dismissing my complaint...is clear violation of its own rules," she says
  • FIFA declares American lawyer Michael Garcia's appeal "not admissible" over his complaint
(CNN) -- A soccer whistle-blower has criticized FIFA's "culture of self-protection" after the world governing body rejected her claim over a breach of confidentiality as the World Cup bidding saga rumbled on.
"Woe be to any other person who cares enough to risk personal safety to report FIFA corruption," said Phaedra Al-Majid, who was in charge of international media relations for the Qatar 2022 bid until 2010, in a public statement.
Al-Majid along with another whistle-blower -- Australian Bonita Mersiades -- gave evidence to American lawyer Michael Garcia, who has investigated the bidding process surrounding the 2018 and 2022 World Cups.
The women claim Garcia ensured they would have anonymity in his investigative report -- and that he broke his promise.

Former adviser: FIFA 'a power unto itself'
It's a report that has become mired in controversy after German judge Hans-Joachim Eckert -- FIFA's independent ethics adjudicator -- published a summary of the evidence the American had collated.
The two women insist that assurances were given to them both in private and public that they would not be compromised after agreeing to give evidence "through a sense of natural justice and a desire to bring closure to a long running chapter in our lives."
The women were not identified by name, but they contend they were "clearly identifiable" in the summary of Garcia's report.
Referring to Eckert's summary, FIFA said; "No names were mentioned in the statement and any information provided was of a general nature. Thus, there was no divulgence of any information of a confidential nature."
FIFA added that Garcia "in his letter to Disciplinary Committee chairman Claudio Sulser, concluded that the complaints by the participants in the investigation were without merit and that, as far as he was concerned, there had been no infringements by Eckert."
FIFA's ruling drew an incredulous response from Al-Majid.
"The conclusion of the FIFA Disciplinary Committee dismissing my complaint against Herr Eckert for breaching my confidentiality is a transparent avoidance of a clear violation of its own rules," she said.
"I cooperated with Mr. Garcia's investigation for over two-and-a-half years under a clear, unqualified promise of confidentiality. He asked me for my confidentiality and repeatedly promised me mine.
"I kept my promise. Herr Eckert breached that confidentiality. I did not. The Disciplinary Committee's avoidance of this undisputable violation is emblematic of its culture of self-protection."
While admitting she had made public statements in the past, Al-Majid insisted they were made "long before I entered into a confidentiality agreement with Mr. Garcia.
"I made no public statements during the entire period of Mr. Garcia's investigation.
"I relied on FIFA's promise of confidentiality and continued to honor my promise until Herr Eckert published his 'Summary.'
"My recent public statements have only been made AFTER Herr Eckert's identification of me in blatant violation of FIFA confidentiality rules."
On Twitter, Al-Majid posted an explanation FIFA had sent her, which seemed at odds with the organization's media release explaining why it had dismissed her complaint, given the letter suggested she was not entitled to complain as she was no longer working in football.
Former head of corporate affairs in the Australia 2022 bid Mersiades was equally critical of FIFA.
"FIFA is nothing if not predictable, and has today surpassed itself in obfuscation and deflection," Mersiades said in a public statement.
"These issues are no longer just about winning bids from Russia and Qatar and losing bids, including Australia. It is about FIFA and the bid process that lent itself to abuse.
What next in FIFA's ethics scandal?
Palios: Unsure FIFA knows what 'good' is
"In FIFA's world, there is no room for ordinary fans. FIFA's world is littered with corruption, mismanagement and self-interest.
"The real football world -- the many millions of players and billions of fans -- deserve a better FIFA, one that is governed by people who make decisions and take action in a transparent manner and who are held accountable in the best interests of the sport and civil society.
"Will a new, independent candidate stand-up to depose the President and build a new FIFA?"
Eckert's report cleared Russia and Qatar, who will stage the 2018 and 2022 events respectively, of wrongdoing and instead was critical of rival bidders England and Australia.
Soon after its publication, Garcia said the 42-page summary contained "numerous materially incomplete and erroneous representations," as he too lodged an appeal with FIFA's appeals committee.
However, on Tuesday FIFA declared Garcia's appeal "not admissible."
"The said statement about the report on the inquiry into the 2018-2022 Fifa World Cup bidding process does not constitute a decision and as such is neither legally binding nor appealable," said FIFA.
"Mr. Garcia has just received the decision and is reviewing it," said a spokesman for the American lawyer. "We have no further comment at this time."

A fugitive former Los Angeles police officer charged with killing a man during an off-duty fight was arrested Tuesday in northern Mexico, officials said.
Henry Solis, 27, was captured by security forces in Ciudad Juarez, across the border from El Paso, Texas, the Chihuahua state attorney general's office said. The arrest was made thanks to an exchange of information with U.S. authorities and intelligence work, it said.
"Henry Solis will be put at the disposition of Mexico's migration office so that he can be handed over to the appropriate authorities," a statement from the office said.
Solis, who was a probationary LAPD officer, was wanted in the shooting death of Salome Rodriguez, 23, outside a nightclub in Pomona, California on March 13. Investigators said the two had gotten into a dispute in the club.
Solis' father was later arrested and charged in a federal court in El Paso with making false statements to FBI agents to help his son escape to Mexico.
According to an affidavit from an FBI agent, on the day of the killing, Solis called his father's home and a short time later the elder Solis left in a hurry.
In an FBI interview, Victor Solis said his son claimed to have five days of vacation and wanted to go to El Paso.
The elder Solis said he drove his son to El Paso, where he dropped him at a bus station early on March 14 and didn't see him again.
Victor Solis also claimed he later crossed the border into Mexico alone but surveillance video captured him crossing with his son, according to the affidavit.
A $25,000 reward had been offered for information leading to the arrest of Henry Solis.

Amnesty International accuses Hamas of torturing, killing Palestinians in new report on Gaza conflict

Amnesty International accused Hamas militants Wednesday of abducting, torturing, and carrying out summary executions of Palestinians during last year's conflict in the Gaza Strip.
The report, the last of four released by the human rights group detailing events during the fighting, said that at least 23 Palestinians were shot and killed by Hamas, which rules Gaza, while dozens more were arrested and tortured. Amnesty said those targeted were either political rivals of Hamas, including members of the Fatah party of Palestinian President Mahmoud Abbas, or people the militant group had accused of cooperating with Israel.
The report detailed one particularly brutal spate of violence, which took place this past Aug. 22.
"In one of the most shocking incidents, six men were publicly executed by Hamas forces outside al-Omari mosque ... in front of hundreds of spectators, including children," the report said. Hamas had announced the men were suspected "collaborators" who had been sentenced to death in "revolutionary courts," the rights group added.
"The hooded men were dragged along the floor to kneel by a wall facing the crowd, then each man was shot in the head individually before being sprayed with bullets fired from an AK-47," the report said of the August incident.
In one section of the report, testimony from the brother of Atta Najjar, an ex-Palestinian Authority policeman imprisoned since 2009 and killed by Hamas last August, described the violence done to him in captivity.
"His arms and legs were broken ... his body was as if you’d put it in a bag and smashed it ... His body was riddled with about 30 bullets," the brother was quoted as saying. "He had slaughter marks around his neck, marks of knives ... And from behind the head - there was no brain. Empty ... It was difficult for us to carry him ... He was heavy, like when you put meat in a bag; no bones. His bones were smashed. They broke him in the prison."
The report also revealed that Hamas used abandoned areas of a hospital in Gaza City to detain, question, and torture captives, even as other parts of the facility "continued to function as a medical centre [sic]".
Hamas used the war to "ruthlessly settle scores, carrying out a series of unlawful killings and other grave abuses," Philip Luther, Amnesty International's Middle East and North Africa director, charged. "These spine-chilling actions, some of which amount to war crimes, were designed to exact revenge and spread fear across the Gaza Strip."
"Hamas forces have displayed a disregard for the most fundamental rules of international humanitarian law," Luther added. "Torture and cruel treatment of detainees in an armed conflict is a war crime. Extrajudicial executions are also war crimes."
The report said 16 of the people killed by Hamas were already being held by the militant group when the conflict erupted and many of them were waiting to hear the verdict of their Hamas-organized trials. "Many had been sentenced after trials before courts whose proceedings are grossly unfair. A number had said they had been tortured in order to extract 'confessions,'" the report said.
Hamas violently seized Gaza from forces loyal to Abbas in 2007, leaving Palestinians bitterly divided with Hamas ruling Gaza and Abbas governing parts of the West Bank. Since then, Hamas has launched thousands of rockets at Israel and fought three wars with the Jewish state. According to official U.N. figures, over 2,200 Palestinians were killed during the 50-day war last summer. On the Israeli side, 67 soldiers and six civilians were killed.
In March, Amnesty International accused Hamas of war crimes for launching unguided rockets and mortars from civilian areas in Gaza toward civilian areas in Israel, saying that was a breach of international law. In particular, the report cited an incident in which a missile launched by Hamas misfired and killed 13 Palestinians, 11 of them children, when it exploded next to a market in a refugee camp.
The first two reports mainly focused on the activities of the IDF and included strong criticisms of the Israeli military and accusations of "callous indifference" and "war crimes", which were again mentioned by Luther. "The fact that Palestinian armed groups appear to have carried out war crimes by firing indiscriminate rockets and mortars does not absolve the Israeli forces from their obligations under international humanitarian law,” he said.
Luther added, “The devastating impact of Israeli attacks on Palestinian civilians during the conflict is undeniable, but violations by one side in a conflict can never justify violations by their opponents.”
In reaction to the latest Amnesty International report, Salah Bardawil, a Hamas official in Gaza, told the Associated Press the incidents mentioned in the report took place 'outside the framework of the law' and Hamas was investigating them.

Christie accuses Paul, Lee of siding with ‘criminal’ Snowden on NSA

Gov. Chris Christie opens up about 2016 plans
New Jersey Gov. Chris Christie lashed out at Sens. Mike Lee, R-Utah, and Rand Paul, R-Ky., on “Fox and Friends” Wednesday, over their efforts to block the renewal of the Patriot Act.
Christie, a fellow Republican and likely presidential candidate who backs the Patriot Act, accused Lee and Paul of "siding with" NSA leaker Edward Snowden.
“He’s a criminal, he’s a criminal and he’s hiding in Russia, and he’s lecturing to us about the evils of authoritarian government, while he lives under the protective umbrella of Vladimir Putin,” Christie said. “That’s who Mike Lee and Rand Paul are siding with – with Edward Snowden? Come on.”
The beef between the senators and Christie has been growing for some time. Christie had told supporters in New Hampshire that “you can’t enjoy our civil liberties if you’re in a coffin.”
Lee later told CNN he found the remark “really disappointing” and it reflected “governing by fear and governing by false choice.” He also said Christie should be ashamed of himself.
The feud with Lee and Paul, a declared presidential candidate, comes as Congress is stuck on what to do about expiring NSA surveillance programs.
Lee backs an alternative to the Patriot Act called the USA Freedom Act. The House-passed bill aims to limit bulk collection of metadata on American citizens. But neither that, nor a straight, short-term extension of the Patriot Act, was able to advance in the Senate before lawmakers left on the holiday break. The data collection program is set to expire at the end of the month.
During his interview on Fox News, Christie also blasted President Obama’s strategy in the Middle East – citing the Islamic State’s growing influence, as well as Syrian President Bashar Assad's.
“If a President Christie had drawn a red line in Syria,” the United Sates would have gone after Assad as promised, he said.
Christie also criticized Obama for not being aggressive enough bringing together allies in the Middle East.
“They need American support and American leadership and American strategic vision, this president hasn’t put it out there, this is the guy who called them the JV,” Christie said. “Now, all of a sudden. He’s got a strategy that’s successful? It’s been disappointing to watch it.”

Texas dam reportedly on verge of failing as death toll hits 17 in storms DAM NEAR MIDLOTHIAN, TEXAS, REPORTEDLY ON VERGE OF FAILING AS SEARCH RESUMES FOR FLOOD VICTIMS Launch Live Player

DAM NEAR MIDLOTHIAN, TEXAS, REPORTEDLY ON VERGE OF FAILING AS SEARCH RESUMES FOR FLOOD VICTIMS
  • Floods

US storm death toll hits 17, as Texas town braces for dam to fail after historic rains

    dam_0.jpg
Police in Midlothian said the dam is expected to fail sometime Wednesday, which will send a flood wave along Highway 287 in Ellis County and affect about 25 homes, the station reported.
DEVELOPING: Officials in a town outside of Dallas Wednesday are preparing for a dam to give way after deadly storms this weekend flooded the state, telling nearby residents they need to evacuate, Fox4News.com reported.
The report of the compromised dam in Midlothian, which is on Padera Lake about 25 miles southwest of Dallas, came as the statewide search continues for 11 people. The death toll from the Memorial Day weekend storms reached 17 in the U.S., and 14 in Mexico.
Police in Midlothian said the soil atop the earthen dam was eroding as water began flowing and the dam is expected to fail sometime Wednesday. Then, the flood wave will hit Highway 287 in Ellis County and affect about 25 homes, the station reported. Livestock owners were asked to move their animals to higher ground.
Officials said the situation is under control and, at this point, the water flow is not dangerous, CBS in Dallas reported.
"All of us are watching it very closely," Stephanie Parker, the Ellis County emergency management coordinator, told the station. "The best-case scenario is happening and we hope it continues to do so."
WATCH LIVE: Midlothian's Padera Lake dam failure imminent
The report said emergency crews are using pumps to alleviate the dam.
The historic storms over Memorial Day weekend, which dumped up to 10 inches in the span of hours in some areas, has prompted new scrutiny for Texas' storm warning system as officials continue to search for 11 missing from the Texas town of Wimberley.
The victims included a 14-year-old who was found with his dog in a storm drain; a high school senior who died after her car was caught in high water; and a man whose mobile home was destroyed by a reported tornado.
In Houston, floodwaters affected virtually every part of the city, paralyzing some areas. Firefighters carried out more than 500 water rescues, most involving stranded motorists. At least 2,500 vehicles were abandoned by drivers seeking higher ground, officials said. Mayor Annise Parker said two people who capsized in a boat that was helping with rescue efforts Tuesday have not been found.
A spokeswoman for the flood district of Harris County, which includes Houston, said up to 700 homes sustained some level of damage. Officials told the Houston Chronicle late Tuesday that flooding had overwhelmed a wastewater treatment plant in the city, causing more than 100,000 gallons of wastewater to spill out.
Texas Gov. Greg Abbott said that he had declared a disaster in 46 counties, adding that damage from the flooding stretched "from the Red River to the Rio Grande." President Barack Obama has said he expressed condolences to Abbott and anticipates significant requests for federal assistance.
In Wimberley, located between Austin and San Antonio, the usually calm Blanco River swelled to an ocean-like squall that crested above 40 feet, more than three times above its flood stage of 13 feet. The river swamped Interstate 35 and closed parts of the busy north-south highway. Rescuers used pontoon boats and a helicopter to pull people out.
Officials in Hays County said that the bodies of two men and one woman had been pulled from the Blanco as of late Tuesday. Their identities had not been confirmed. Eight of the 11 people who remain missing from the area were in a vacation home that was swept away and slammed into a bridge downstream. Two 6-year-olds and a 4-year-old were among those inside. They have been missing since early Sunday morning.
Meanwhile, authorities defended their alerts to residents ahead of the weather, which included alerts via phone and in person, but acknowledged challenges with reaching tourists and said a messaging system in Houston is still waiting for improvements.
"Nobody was saying, 'Get out; get out; get out,'" said Brenda Morton of Wimberley, who lives three houses down from the home that was swept away. "We're pretty trained, so we were calculating. We knew the flood plain. People who were visiting or had summer homes, you have company from out of town, you don't know. You don't know when that instant is."
Authorities in surrounding Hays County said warnings included multiple cellphone alerts and calls to landlines. Some received in-person warnings to evacuate, but officials could not say whether those in the washed-away home talked to police.
"Law enforcement made notification along that street. Whether they made contact with somebody at their residence, I can't say," Hays County Emergency Management Coordinator Kharley Smith said.
Wimberley, a popular bed-and-breakfast getaway near Austin surrounded by wine vineyards, thrives on weekends like Memorial Day. Some of the missing had homes in the area, but officials have acknowledged that their electronic alerts may not reach tourists.
"Most definitely, most definitely that will certainly be part of our discussion," Hays County Commissioner Will Conley said.
